General conditions of sale

COULEUR CROATIE is a website and tourist agency, a service provider company that offers holiday accommodation to clients. Couleur Croatie is the rental provider on behalf and for the account owner. In this capacity, Couleur Croatie:

- sends in the form of a contract to the client the description, price, terms of reservation, terms of payment as well as any other useful information, and

- organizes the reservation with the owner. Couleur Croatie establishes a strict contract that matches the General Conditions of Sale with each owner. The owner has to respect the contract and is completely involved concerning reservation and stay. All exchanges between Couleur Croatie and the clients are email.

Almost all of the photos on our site have been taken by ourselves or transmitted by the owners of the rentals. Some photos have been lent by and published with the agreement of the Croatian National Tourist Office, within the framework of the promotion of tourism in Croatia.

1/ The service offered

All the properties we propose are categorized in accordance with the official standards in force in Croatia as defined by the Ministry of Tourism. The property owners have official authority to carry out this activity.

As an intermediary, Couleur Croatie visits all properties, publishes online its own photos and writes the description according to what they have seen. These documents do not carry any legal obligation for the service provider.

The prices shown on the site include the various expenses (water, gas, electricity) and any extras are written in the documentation for the accommodation (pets, cleaning, air-conditioning upon request …)

Some owners may ask for a deposit on arrival at the premises to cover potential damage or lack of cleaning of the property at the end of the stay. This deposit is to be paid in cash and is refunded on departure; whenever this is a condition, it will be stipulated in the description.

A tourist tax has to be added on, in accordance with the legislation in force in Croatia and should be paid directly to the owner at the start of the stay. In some cases, the tax is already included in the price, in which case this information is mentioned in the written description of the property.

Applicable prices are those displayed on the site on the day of reservation. The prices may be modified at any time without precondition by Couleur Croatie.
In the event of unforeseen circumstances causing delay of arrival or early departure, no partial reimbursement will be made since the rental property incurs a fixed cost from start date to end date.

2/ Reservation and payment

Couleur Croatie proposes 2 terms for reservation:

A/ Reservation by request of availability

B/ Instant reservation. This term is available only for some rentals and it is indicated on the offer.

Terms of reservation A:

1/ The client must send a request to Couleur Croatie by filling in the form to check the availability of the accommodation at the required dates; the client has to choose the payment type: secure credit card payment or bank transfer.

2/ Couleur Croatie will contact the owner for approval and then send confirmation of availability by email to the client in the shortest time. The email will contain all the details of the request including the total price of the rental and terms of payment.

3/ As soon as Couleur Croatie send the confirmation of availability to the client, the client must confirm the reservation within 2 working days by paying the deposit, according to the terms concerning the chosen rental and which were transmitted by Couleur Croatie.
Couleur Croatie cannot guarantee the availability of the accommodation beyond this deadline.

4/ The client has to pay the deposit generally of 30% (more or less according to the rental) of the total amount (corresponding to the deposit transferred to the owner by Couleur Croatie and the agency commission) by credit card or bank transfer to the account Couleur Croatie whose details are transmitted with the confirmation of availability. The banking charges for an international transfer are to be paid by the client. As a member of the European Community, Croatia is in the area SEPA and the costs are minimal.
Receipt of the payment of the deposit secures the final reservation. Couleur Croatie sends the confirmation of the reservation by email to the client.
In some cases, the amount of the deposit may be more or less than 30%; in that case, it will be clearly stated on the accommodation page.

Terms of reservation B:

1/ The client must fill in the form of reservation; he indicates the chosen dates of arrival and departure, the number of persons (adults, children) and contact details (name, address, phone..).

2/ If the reservation is valid, the client must pay the deposit generally of 30% (more or less according to the rental) of the total amount (corresponding to the deposit transferred to the owner by Couleur Croatie and the agency commission). The payment is made only by credit card. Receipt of the payment of the deposit secures the final reservation; Couleur Croatie sends the confirmation of the reservation by email to the client.
In some cases, the amount of the deposit may be more or less than 30%; in that case, it will be clearly stated on the accommodation page.
In both terms of reservation, the payment of the deposit implies that the client has read and accepted the General Conditions of Sale.

Payment:

The balance of the total amount of the rent may be paid in one of two ways chosen by the owner; the terms required by the owner are specified in the offer:

1/ Cash in euros to the owner, directly on arrival.

2/ By transfer to the bank account of Couleur Croatie or by credit card, as chosen on reservation, at least 40 days before the start of the stay. Couleur Croatie transfers the total amount to the owner.

For option 2, in the case where a reservation is made within 40 days of the start of the stay, the total amount of the stay is to be paid upon reservation by transfer to the bank account of Couleur Croatie or by credit card.

In any case, the banking charges for an international transfer are to be paid by the client. As a member of the European Community, Croatia is in the area SEPA and the costs are minimal or free by internet.

Note: All payments made by transfer to the bank account or by credit card are in Euro (the Croatian currency)


Possible exceptions:

1/ In some cases, payment terms or cancellation conditions may be different to be adapted to specific situation (specific accommodation or additional services), in which case they would be specifically mentioned on the accommodation page on our website and written in the booking contract.

2/ If booking last minute and if chosen term of payment is bank transfer, to accelerate the booking process, simply send us proof of the transfer request made to your bank so that we consider it effective.

Sending of exchange voucher :

The voucher will be sent by Couleur Croatie to the client by email:

Option of payment 1: upon receipt of the deposit on the bank account of Couleur Croatie.

Option of payment 2: upon receipt of the balance on the bank account of Couleur Croatie.

This voucher specifies the contact details of the people on holiday, the number of people, the arrival and departure dates, the chosen property, the payments made and the remaining payments in the case of payment on arrival. Along with the voucher, the client will be sent the contact details of the owner, the address, a map and any other useful documents.

The voucher is to be given to the owner in exchange for the property.

3/ Changes and cancellation

Changes:

Any request for change should be made by email to Couleur Croatie. Changes of date or of number of people for a property with the same owner will be made free of charge if the new request is possible.

In all other cases, the original request is subject to the cancellation rules.

Cancellation:

Any request for cancellation should be made by email to Couleur Croatie. The date of receipt of the cancellation is authoritative for the costs to be paid.
For any cancellation made by the client, the amount of the deposit is not refund to the client, whatever the option of payment.

For option 2 of payment, costs to be paid by the client who made the reservation are as follows:

- Cancellation between 40 and 20 days prior to the arrival date: 60% of the total amount.

- Cancellation between 19 and 8 days prior to the arrival date: 80% of the total amount.

- Cancellation at 7 days or less prior to the arrival date or if the client does not turn up without having informed the owner of an unforeseen delay: 100% of the total amount.
The amount to be refunded will be paid back to the bank account of the client by Couleur Croatie within 30 days from the date of cancellation.

4/ Cancellation of the contract by the service provider Couleur Croatie

In the event of Couleur Croatie being obliged to cancel the contract because of natural disaster or impossibility of accommodating the client, an alternative solution will be offered wherever possible.
If no solution can be found for the client or if the client does not wish to accept the solution offered, they will receive full reimbursement of all the amounts paid, including bank charges.

5/ Obligations and responsabilities

Obligations and responsabilities of Couleur Croatie

- The agency must comply with the Terms and Conditions of Sale and is responsible for the provision of service to the customer, respecting the rights and interests of the customer and conforming to current practice in the tourist sector.

- If unable to provide all or part of a service, Couleur Croatie is committed to providing a response to the client with an explanation.

- In case of unforeseen force majeure (death, serious illness, natural disaster, major damage to the property ...) which means it is not possible to fully or partially guarantee the availability of the rented property (before arrival at the property or during the stay) Couleur Croatie must make every effort to offer the customer an alternative: provision of a property of equivalent or higher standard. In cases where an alternative is not possible or not desired by the customer, Couleur Croatie will refund the customer the amount corresponding to the service that could not be guaranteed; the full amount or an amount in proportion to the remaining days, depending on when the force majeure occurred.

- As the sole service provider, Couleur Croatie can under no circumstances be held responsible for potential bodily or physical damage, theft, disagreement with the owner, climatic conditions or any other problem that might arise during the stay at the holiday premises.

Any service offered in addition to the accommodation (rent a boat, rent a bike, transfers, tours, activities...) is managed directly by the owner or company in charge of these services. Couleur Croatie cannot be held responsible for any bodily, tangible or intangible damage concerning these services.

Occupation of the premises / obligations of the client

On arrival at the premises, the client must:

- Give the voucher to the owner and visit the property to notify the owner what would not comply.

- Pay the balance in case of option 1 of payment: directly to the owner on arrival, in euros cash.

- Pay the required tourist tax if it is not included in the price.

- Not exceed the number of people for whom the property has been reserved; not bring pets if this has not been included in the contract. In the case of non compliance relative to the contract of reservation, the owner has the right to refuse access to the premises or to request an extra charge.

- Comply with the arrival times (and departure times when leaving the premises); arrival is generally expected after 2pm and departure before 10am. In the event of circumstances causing delay, the client must warn the owner and come to an agreement.

During the stay, the client is responsible for:

- Respecting the conditions of the premises, taking care of them and leaving them clean and tidy on the day of departure.

- Taking care of the housing equipment: appliances, furnitures…

- Observing the house rules and not causing any damage.

- Dealing directly with the owner for any potential problem arising during the stay (electrical breakdown, breakages, leaks.

The reviews

The reviews appearing on the rentals are exclusively written by people having made a stay there. Couleur Croatie reserves the right not to publish the comments which would be deliberately harmful as well as any not justified unfriendly or extravagant remark.

Complaints

Any complaint must be notified to Couleur Croatie by registered letter within a maximum deadline of 7 days following the end of the stay. After this deadline, the complaint will not be acceptable any more. No complaint will be taken into account if this one concerns a problem having been resolved amicably on place.

6/ Privacy Policy

Declaration of collection and protection of personal data and their use.

COULEUR CROATIE is committed to protect the privacy of personal data of all our customers, in order to: collect only essential data about customers / users that allow us to fulfill our commitments, report to clients how to use the data collected and regularly offer buyers the option of choice for the use of their personal data, including the possibility to decide whether they want to be removed from mailing lists that are used for marketing campaigns. All user information is strictly confidential and accessible only to employees who need the information to perform the work. All COULEUR CROATIE employees and business partners are responsible for compliance with data protection principles.

When making inquiries, i.e. submitting reservation requests, at registration or when contacting us via webpage www.croatie-loaction.fr, the customer confirms that they have read and accepted the general terms and conditions of sale, rules on security and protection of individuals regarding the processing of personal data and that they give consent to the Couleur Croatie tourist agency, its affiliates and accommodation owners to use their personal information (name, surname, address, e-mail, telephone number) for the purpose of making reservation and in order for us to provide the customer with the best possible service. We will share your personal information with our business partners and accommodation owners so that we can conclude reservation or some other service you have purchased.

If you do not want us to keep your personal data and you do not want us to share them with our business partners and accommodation owners we kindly ask you to send an e-mail requesting the deletion of your personal data.

7/ Relevant jurisdiction

In case of a dispute, the client and the agency will do their best to reach an amicable settlement. If this does not lead to a solution, the relevant court is the court of Zadar under the law of the Republic of Croatia.

The Terms and Conditions of Sale may be modified at any time by Couleur Croatie. The terms applicable are those in effect at the date of the booking made by the customer.
